These Terms of Use (“Terms”) govern access to buyersgems.com, related subdomains, and applications provided by Buyer’s Gems LLC (“Buyer’s Gems,” “we,” “us,” or “our”) that reference these Terms (collectively, the “Services”).
Please read these Terms carefully. Where we ask you to accept these Terms, your acceptance forms an agreement between you and Buyer’s Gems LLC. If you do not agree, do not use the Services.
1. Additional terms
An individual application, paid feature, or other Service may have additional terms, including a separate license agreement or purchase terms.
We will make applicable additional terms available before you use or purchase the relevant Service. If those terms conflict with these Terms, the additional terms will control for that specific Service.
App-store terms and applicable third-party software licenses may also apply.
2. Eligibility
The Services are not intended for children under 13 unless an individual Service expressly states otherwise and provides appropriate terms and safeguards.
If you are under the age of legal majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian who agrees to the applicable Terms.
If you use the Services on behalf of a business or organization, you represent that you are authorized to accept these Terms on its behalf.
3. Permission to use the Services
Subject to these Terms, we grant you a limited, nonexclusive, nontransferable license to access and use the Services for their intended purposes.
For downloadable applications, this includes permission to install and use the application on devices you own or control, subject to applicable app-store rules and any app-specific license.
This permission does not transfer ownership of the Services or our intellectual property to you.
4. Accounts and security
If a Service offers user accounts, you agree to:
- Provide accurate account information and keep it reasonably current.
- Protect your login credentials.
- Avoid sharing access in a way that violates applicable app or purchase terms.
- Notify us promptly if you suspect unauthorized access.
You are responsible for activity you authorize through your account. Nothing in these Terms makes you responsible for unauthorized activity to the extent that applicable law provides otherwise.
We may take reasonable steps to verify account ownership or protect an account from suspected misuse.
5. Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, or deceptive purposes.
- Infringe another person’s intellectual property, privacy, or other rights.
- Upload malicious code or intentionally interfere with the Services.
- Attempt to access another user’s account or nonpublic systems without authorization.
- Bypass security measures, access restrictions, or payment requirements.
- Use automated tools in a way that disrupts the Services or imposes an unreasonable technical burden.
- Impersonate another person or misrepresent your affiliation with an organization.
- Harass, threaten, or abuse other users or our support staff.
- Resell or redistribute the Services unless we expressly permit it.
- Reverse engineer an application except where applicable law or a relevant software license permits it.
Nothing in these Terms prohibits honest reviews, lawful criticism, reporting suspected misconduct, or exercising rights protected by law.
6. Your content and information
You retain ownership of content you submit to the Services, such as messages, files, records, or other materials (“Your Content”).
You are responsible for ensuring that you have the rights and permissions needed to submit Your Content.
To the extent necessary to provide a Service you choose to use, you grant us permission to host, process, transmit, display, and reproduce Your Content for that purpose. This permission does not authorize unrelated advertising use or public publication of private content.
For example, submitting a support message permits us to process the message and share it with service providers assisting us in responding.
Our handling of personal information is described in our Privacy Policy. Accepting these Terms does not replace any separate consent required by privacy law.
Where available, use the Service’s export or backup features to keep copies of important information. Backup responsibilities and capabilities may differ between apps.
7. Feedback
You may send us suggestions, bug reports, or ideas for improving the Services.
You permit us to use voluntarily submitted product suggestions to improve our Services without an obligation to compensate you, unless we agree otherwise in writing.
This provision does not transfer ownership of your reviews, personal information, or unrelated creative work. Please do not send confidential business information unless we have agreed to receive it confidentially.
8. Purchases and paid features
Some Services may be free, while others may require payment.
Before a purchase, the applicable purchase screen or app store will describe the price, included features, and relevant payment terms.
If we offer a subscription, its billing frequency, renewal conditions, cancellation process, and any trial terms will be disclosed separately before enrollment. These Terms alone do not authorize recurring charges.
If you purchase through an app store or another platform, that platform may process your payment and manage cancellations or refund requests under its own rules.
Refund eligibility depends on the disclosed purchase terms, applicable platform rules, and applicable law. Nothing in these Terms limits a refund, withdrawal, or other consumer right that cannot legally be excluded.
9. Ownership of the Services
Except for Your Content and materials owned by third parties, Buyer’s Gems or its licensors own the Services and their associated software, designs, graphics, branding, and other materials.
You may not copy, distribute, modify, or exploit those materials beyond what these Terms or applicable law permit.
Third-party trademarks remain the property of their respective owners. Open-source components remain subject to their applicable licenses.
10. Third-party services
The Services may contain links to third-party websites, app stores, integrations, or other services.
Those third parties operate independently and may have their own terms and privacy policies. We do not control their content or practices.
A link does not necessarily mean that we endorse the third party or guarantee its products or services.
11. Updates and availability
We may release updates to improve functionality, address security issues, correct errors, or maintain compatibility.
Some updates may be necessary for continued use of an application or online feature. Availability may depend on your device, operating system, internet connection, or third-party platforms.
We may change or discontinue a Service. Where a change materially affects a paid Service, we will provide notice and any remedy required by the applicable purchase terms or law.
We do not promise that every Service will be available continuously or that every suggested feature will be developed.
12. Informational tools
Unless a Service expressly states otherwise, our applications provide general organizational or informational tools.
Their content and outputs are not a substitute for professional medical, legal, financial, or other specialized advice. You should independently verify information before relying on it for a significant decision.
App-specific notices may explain additional limitations relevant to a particular product.
13. Suspension and termination
You may stop using the Services at any time. Stopping use or uninstalling an app does not necessarily cancel a subscription; follow the cancellation instructions provided at purchase or by the relevant app store.
We may restrict or suspend access when reasonably necessary to:
- Address a material violation of these Terms.
- Prevent fraud, abuse, or a security threat.
- Comply with a legal obligation.
- Protect other users or the Services.
Where reasonably practical, we will provide notice and an opportunity to resolve the issue. Immediate action may be necessary for serious violations, security risks, or legal requirements.
Any termination of a paid Service remains subject to applicable consumer rights and purchase terms.
Provisions that reasonably need to continue after termination—including ownership, payment obligations already incurred, and applicable liability provisions—will survive.
14. Warranties and disclaimers
We aim to provide useful and reliable Services. However, to the extent permitted by applicable law, the Services are provided “as is” and “as available,” without additional implied warranties of merchantability, fitness for a particular purpose, or noninfringement.
We do not guarantee that the Services will always be uninterrupted, error-free, or compatible with every device.
These disclaimers do not override an express promise we make to you or exclude any statutory warranty, guarantee, or consumer right that cannot legally be excluded.
15. Limitation of liability
To the extent permitted by applicable law, Buyer’s Gems will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services, including lost profits or business opportunities.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any other liability that applicable law does not permit us to exclude or limit.
If your jurisdiction does not permit a limitation described above, that limitation applies only to the extent legally permitted.
16. Governing law and disputes

If you do not agree to updated Terms, you may stop using the affected Services, subject to any applicable purchase terms and consumer rights.
18. General provisions
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Our failure to enforce a provision does not waive our ability to enforce it later.
These Terms and any applicable additional terms form the agreement concerning your use of the Services. They do not limit rights or remedies that cannot legally be waived.
